Yep necessary and proper clause- article I section 8. It gives congress the ability to have powers over more areas than were mentioned in the constitution explicitly, things the writers of the constitution could have never anticipated. It gives congress a more expanded power. This clause has already been found to give congress the power to regulate banking, establish post offices and raise military forces.

Q: Hey All, So my family has been having trouble concerning my grandmother and grandfather and their possessions. They have both been placed in a nursing home, and at this point both are not both there.in non-scientific terms. But, a few months ago before their state deteriorated, my mother typed up a document that stated she would be in charge of their bank card, vehicle, etc. She had it signed by my grandmother, signed by a witness, and notarized. Is that considered official document making her the power of attorney? If so, does that mean anything listed in that document is now her responsibility? Thanks
A power of attorney is permission for your mother to act just as your grandmother would act. She would be able to sign her checks, sell her car pay her taxes, etc. The power of attorney is just a notice to everyone that your grandmother gave your mother permission to do stuff for her. It does not mean that your mother HAS to do the stuff. It sounds like the document that she and your grandmother signed is a good power of attorney. - Stuart
Q: I tried to have a check made out to my husband cashed today. He is depolyed and I have power of attorney. The bank said they are refusing my power of attorney and he would need to be present to cash the check. I advised them he is deployed and they still denied it. I need to cash this since we have no money at the present and it seems to me that power of attorney is the same as having him there. Any ideas on what to do or who to call. Each bank may have rules on what they accept. Is this the bank that he banks with? If so, he should have contacted them before he deployed to give them the POA and advise them to allow you to do things on his behalf. If not his bank, they don't know for sure that he signed it, so they really do not have to honor it, from what I understand, just like some states do not honor a POA for certain things (like vehicle registration in my former state, you HAD to have the Special power of attorney). Hopefully JAG can help you out a little more. Its frustrating when the military tells you that this should work for you, but then it doesn'tI understand as my husband was deployed last year. Neither of you need to cash the check. You need to put it in a savings account for her (if not needed to pay her bills), or in a interest-bearing checking account. Spend only what is absolutely necessaryno splurging for either of you.

I am sorry for your loss. However the bank will not let you withdraw any funds after the death certificate has been issued. If your mothers death has not been certified and you do not have the certificate go to the bank and try to withdraw as much as possible. If the certificate has been issued you are out of luck as the POA expired with her death and you will need to go to the bank with a certified copy of her death certificate, the POA papers and hope they will issue the funds to you at that point. Otherwise you are stuck waiting until probate goes through which can take forever.
