Just a little side note- Perhaps you may be aware that in some states, an attorney may apply to sell real estate without taking real estate educational courses. Being loyal to a friend is a very important and frequently overlooked virtue. With that said, here's my answer as follows: Stretching your budget to pay an unnecessary fee just isn't practical. Neither is bickering with your spouse. I would explain to your friend that funds are tight, but that you looked at every possible way to pay them a fee. Perhaps you could take them out for lunch and have a heart- to- heart discussion. Promise that you will spread their name around in a positive manner to friends, family, neighbors, and colleagues. A real estate sales person will appreciate your referrals and provide them with instant credibility. People who are not your real friend will not accept any excuse as being satisfactory; true friends really don't need an excuse.

- I understand your frustration. The housing market across the country is flat and things are just not moving. You are absolutely correct your agent is suppose to be working for you, not just waiting for someone to come along and buy the house. If your house is being shown, your agent should be contacting you with feed-back on what the comments of those looking at the house are and if there are anythings you could do to help your house sell faster. If you truly feel that your agent is not working for you and doing things that you have contracted her to do, talk to the Broker who runs the office. Explain that you feel the agent is not doing their job and request to be released from the listing agreement. Most Brokers will void the contract when someone is truly not happy with their agent. - You do have a problem. You need to attack the deed to your brother as a 'fraud in the factum.' There are two kinds of transactional fraud: fraud in the inducement and fraud in the factum. Fraud in the inducement would be where your brother said, 'sign this deed and after I refi the house, I'll put your name back on it.' Your claim is that you would not have signed without his promise. This case would lose. Fraud in the factum results because he had you sign a document, a deed, while saying it was a contract to enable him to refi the house. Very hard case, but potentially winnable. Speak to an attorney, you need to sue your brother for this fraud. This is not a case of not reading the contract. It's a case where a person you used to love and trust lied to you and misled you and stole from you. Very different from what the Brand X poster described, but then, I actually went to law school and have 30 years' experience counseling clients and suing bad guys. I am sorry that your brother turns out to be a rotter. You will need to file a notice of pendency BEFORE the house closes escrow...and that will put the kibosh on the closing. Do it right away, and be prepared to move out, 'cos your brother sounds like a potentially dangerous grifter. The poster below me (he was above me, but you should be able to tell whom I'm referring to) is a person who appears to be impersonating an attorney. He has enough knowledge to get things right once in a while, but this (as is usually the case) is an area where actually graduating from law school would teach one how to respond to this problem. Nor has he done much real estate title underwriting, or he would know that the fraudulent conveyance risk is one of the most common causes of loss in the industry. Usually, when two or more investors are working together, they refer to each other as partners. It doesn't mean you need a formal written agreement--although that oftne would be preferable. What it means is that you're partnering up on the deal. You really have two questions: How do you deal with buyers, and how do you deal with the person putting the house under contract. I assume you have some relationship worked out with the person who's putting the house under contract. If not, you should. And, preferably in writing, though lots of investors do rely on handshakes. And you can split the deal whatever way you want. Just make sure you and your partner are clear on what the compensation method will be. As for dealing with buyers, get all the buyer information you normally do: what they're looking for, how much they have for a deposit or down payment, whether they'd buy outright or use a lease-option to buy, what they want to pay, and so on. Really, as much detail as possible. You already know all that. You explain to the buyer: I have a partner who finds homes for buyers like yourself. Here is his contact information. With your permission, I'll let him know that you'll be contacting him. That way, he can begin searching for a house that will work for you. Is that OK? Of course it'll be OK. Then, as soon as you have a chance, send the buyer's information to your partner. That does a couple of things: It really does let the other investor start searching for homes that meet the buyer's needs.
