Q: Hello,I'm not looking to do Real Estate full time or represent others. The purpose of obtaining my license is to purchase and sell on my behalf but primarily to gain access to MLS. Can I do this without a broker? A license by itself does not grant MLS access. MLS is a commercial service provided to BROKERS. You'd need to be a licensed agent working for a broker.

Business is great but if you want to pursue real estate, law, especially contract law is very advantageous. Get a BA or more, obtain your real estate licence(easy) and then look for a commercial brokerage to start with. If you want to understand what being a landlord is, you want to learn from landlords or the guys that work with them. You can make money selling homes but you will not learn about being a landlord working for a residential Realtor. There are something things you can't learn with out doing them.

Do you have real estate agents that you have done real estate investment transaction through before? If you have little or no experience in real estate investing it might be that you would obtain local assistance in this transaction. In the event there is a commission to be made in this transaction you would be able to split the commission. You might would want to inquire of this investor what his desires are as to what he would like to invest in. You should prepare a survey for him as to his desires in investing in south Florida. Once yo know this information you would know exactly what to look for and the mix he would be looking for. Knowing this information would make your job a lot easier as you would be looking for exactly what he is looking for and not throwing apartments, hotels, mixed use property, commercial property against the wall and hoping something stick. Of course you would need a contract from this investor indicating you are the primary agent in this transaction and would be paid a commission once the investment property has been purchased. Depends on your point of view or how much real estate values affect you. The sad fact is , in many states people would not be able to swing the mortgage on the house they currently own if they were to buy it again. How can they expect the young , with the outsourcing of jobs and the mediocre economy to support this housing inflation. Most of this hyper- pricing was brought on by speculation just as with stocks in the late nineties and upper end real estate on the west coast in the early nineties. Money chasing dwindling avenues of investment after the 7 trillion dollar equity collapse.Sure hope you didn't take out a home equity loan.

In many states you do not have to live in the state at all- but of course to succeed I think you should live in the exact area you want to do business in and become very familiar with the area. The schooling is just to pass the state test. The company you work for will help you learn how to succeed (or should help you).

Is this a home you bought? After the home has closed, the agent has no right to go into the property without permission. I have gone back to remove the lockbox, but that does not involve going inside the property. I don't think she should have gone in to retrieve anything without permission, but to get laws in your state, contact your local Dept of Real Estate and ask if it is an infringement. If you are upset about it, file a police report. If you don't trust the agent to get mail, you must have a reason. So she is your agent? You have a contract with her? Dual situations are a bit sticky, you could have insisted that she referred out the buyers to another agent in her office so that this wouldn't have become an issue, but it's a little too late for that. I'm not sure it necessarily tresspassing since she is your agent, but if she did take mail addressed to you from you house, I believe that is against the law... mail tampering/theft is a federal offense. If you are not at all satisfied with how she is handling this transaction, here is what I suggest you do: Your listing is not with her, it is with her broker. Her broker is essentially the person/entity you have an obligation to. Call the broker directly and bring up your concerns. The broker can assign a new agent for you to deal with through the closing of your house... I would make it known that you are extremely unhappy with her entering your house without your knowledge searching for mail in your name. The broker's reputation is on the line... also the broker is liable legally and will jump to remedy the situation immediately. Don't hesitate to act on this... make the agent know that this is unacceptable and the broker will probably not allow her to take on the dual agency role in the future as its obvious she can't handle it (some agents can, but it is tough).
