Q: My real estate lawyer for home closing was suggested to me by my mortgage company. He told me he has worked with this lawer in the past and he is good. I took the lawyer. I then had a problem with the mortgage company. The company was negligent in missing my closing date. When I asked the lawyer about having to possibly open a lawsuit against the mortgage company, the lawer said he could not as he represented both myself and the bank. Is this the usual practice for a closing lawyer to represent both parties.
You need a real estate agent and you need an attorney. First you need to know who the real estate agent represents. They could be representing the seller and in that case they could not be working in your best interest. They could be representing both the seller and buyer and merely doing the paperwork and not looking out for either of your interests, they are in that case merely facilitators. If you asked for an attorney, they suggested theirs to you which sounds to me like both the mortgage company and the attorney are on the seller's side if you are the buyer...and no one is on your side. You need to hire your own attorney to represent you. To answer your question....you need to saavy when you buy a house (or sell a house) so that you are protected. Get yourself a real estate attorney. If you don't know one then call your county bar association and ask for an appointment with a real estate attorney who also could sue a negligent mortgage company for missing a closing date. Then talk that out at your appointment. Sure, only one side can be represented in a deal. It's done. But, you need an attorney to protect you and now you found out why that is.
Q: I have been contributing to a few retirement investment plans and I think that I'm on the right track. Real estate is a good investment but all it would take is a market crash to kill you. Don't put all your eggs in one basket. Have a well funded retirement fund, I recommend a long term fixed income bond at 10%+.

Are YOU a Filipino citizen? Then there are NO best real estate investments as foreigners are forbidden to own land there. It's that simple. Think you can ''get around'' the rules? Think again, many have tried , ALL have failed. You are either a Filipino or a renter. You can own a Condo, but NOT the land it sits on. Ever. Try Thailand or Vietnam.

No its not necessary; your main issues is to ensure you get the property with clear title and title insurance That said, where a lawyer comes into play is not all the closing documents but if you where to run into problems before the closing is with specific language of the sales agreement and how its applied to situations which arise after the inspection of the home , Remember the sales agreement is drafted by the selling agent it favors the seller not the buyer, beware of any timing requirements, do you have a inspection clause to get out of the deal if inspection goes bad, it also will address if and how you can get back your escrow monies if the deal fails etc If your savvy then probably not; buying new construction probably not, buying older home needs work, has lead issues or buried oil tank maybe then might be a good idea

That is a problem that I have found with real estate people. they appear to be merely sales people that have been picked up off the street and run through some simple perfunctory classes for a few weeks and then they are turned loose to represent you on the most important financial decision that you will make in your life. A doctor cannot remove so much as a simple hang nail with out 4 years of medical school and 3 years of a residency on top of that . They also must pass a very rigorous licensing exam. Real estate brokers can do far more damage than that doctor removing a hagnail if they make a mistake. Yet real estate agents have almost no training and no real professional standards to speak of This needs to change. I recommend that you contact your Congressperson. Find out if they support rigorous new Federal Legislation to require much more rigorous federal licensing standards and federal licensing requirements for Real Estate Brokers and loan officers who are involved in a purchase or refinance involving a Federally Insured Loan. Federal Licensing will permit much more rigorous Educational, examinattion and training and experience requirements than is now required of real estate agents and real estate lenders. By introducing much more rigorous educational, examination and training requirements and also new tests of character requirements and financial responsibliity when they make mistakes we will weed out many of the frauds and the incompetent and will be left with a much more competent and honest group of people in the real estate industry. .

My okorder and research the answers and questions. Pretty much all of the companies expect to see you in better light at the interview. So if they ask you a question like: How competitive are you, on the scale from 1 to 5? you need to go one step higher from the truth. if you are 3-4, you need to say '5'. They expect that. if you say 4, they will assume that its either 2 or 3. and for the real estate job you need to be very competitive. hopefully this helps a little.
