Q: Is there anything that your real estate agent could have done better? What did they do or not do that stood out?
When I was looking for a home 5 years ago, I contacted a realtor well in advance (I was then living in another state). We corresponded and I gave her all the specifics on when I'd be arriving to see property in her area. After my arrival, I found she had left on vacation! The nerve, and I had spent months researching the area, etc. So, her assistant was there and she showed me around, even took me back to the airport when I left! Now there was someone I wanted to do business with again...and I did, when I bought my home I used her, not her boss. So there! Basically, I find out of town realtors to be really lousy when it comes to helping out. They think just because you haven't moved yet, you won't be a client...not true of course. This has happened to me two times (not being serviced properly by agents out of town). It is very frustrating and their behavior is unprofessional.

We have been looking for a new home for a long time, but can't find anything pre-existing that we want to buy despite his best efforts. We have decided to build new. Just a little side note- Perhaps you may be aware that in some states, an attorney may apply to sell real estate without taking real estate educational courses. Practicing attorneys (members of the State Bar) exceed the educational requirements for salesperson licensees, and meet the educational requirements for broker licensees. In addition, some state laws provide broker licensees expanded abilities for practicing attorneys. I just thought that this is an interesting fact. Being loyal to a friend is a very important and frequently overlooked virtue. With that said, here's my answer as follows: Stretching your budget to pay an unnecessary fee just isn't practical. Neither is bickering with your spouse. I would explain to your friend that funds are tight, but that you looked at every possible way to pay them a fee. Perhaps you could take them out for lunch and have a heart- to- heart discussion. Promise that you will spread their name around in a positive manner to friends, family, neighbors, and colleagues. A real estate sales person will appreciate your referrals and provide them with instant credibility. People who are not your real friend will not accept any excuse as being satisfactory; true friends really don't need an excuse.
Q: My wife and I have a home that we would be interested in purchasing that recently fell into preforeclosure on 9/21/11 in Florida. This is a vacant Bank of America property that has not been lived in for well over a year. The previous owner moved out and is current on the taxes. To persue interest in this home, do we need a realtor, real estate attorney, or both? It would be my guess that this home will be a short sale.In the past, we have went to realtors with short sale housing interests, and are left waiting for the phone to ring. Most of the time, a return phone call or email is asking too much. I realize there is a lot of patience needed in the short sale process, and we are wanting to use the most effective method. You do not need an attorney not a real estate agent. If the property is in pre-foreclosure and is still owned by the person then you might contact this person. Once contacted you would have to make a offer,sign a contract with the sales price, amount you are giving the owner for his equity and take this contract to an escrow closing agent. Make sure the contract say Taking the property Subject to the existing mortgage. The closing agent and title company would understand this statement. These two licensed companies would ensure your transaction would close according to the local, state and federal real estate laws. Taking title to the property in this method, the current owner would still be on the mortgage loan, your name would be on the title deed and recorded by the title company at the county court where the property is located. Paying and keeping the mortgage loan current, in approximately one year you would be able to refinance the property through another mortgage lender. In addition to you giving the current owner funds for his equity you would have to bring the foreclosure current. The escrow closing agent would send a document to the lender requesting the amount needed to bring the mortgage loan current. You might consider this as the down payment. Let me make sure I have the facts straight: 1) 2 years ago, you paid someone $15,000 for some investment property. You paid this amount of money without having a title search done, and getting a warranty deed? 2) You are now complaining because in order to get a loan for the property, you are being held accountable for the lien on the property. 3) If the the person you purchased it from was a realtor, and/or you used the services of a realtor to represent yourself, you *MAY* have a suit for professional negligence/incompetence. It would be, in my opinion, professional malpractice for any real estate professional, (including an attorney if one was involved) to allow the sale to go through without a warranty deed and a title search. As you probably know by now, a quit claim deed makes no warranty of title. It just says that the person granting to you the property does so. A warranty deed, on the other hand, warrants or guarantees to you that there is a clean title. You need to consult with a real estate attorney in your state to determine what might be done. The attorney will assist you in finding the individual to help recover your money, because it is probable that there is fraud involved. Unfortunately, the chances of you recovering any monies from this individual may be pretty slim, based on the fact pattern you gave us. This should be a reminder to everyone reading this: DO NOT buy any piece of real property without a title search and a warranty deed. Never sign anything you don't understand without asking a lawyer about it. If you need a lawyer and don't have one, contact your local or state bar association and ask for a referral to a real estate attorney in your area.

This is one of the very most basic questions asked on the real estate exam. The first and most underlaying principle in real estate is that the agent puts the best interest of the client before her own. Obvious this agent isn't doing that. This is illegal. A Realtor or agent is required to put the client's interest before her own. By asking the client to wait to make an offer until after she changes brokerages demonstrates that she is putting her own best interest before the client. What would happen if the seller received and accepted another offer in the meantime? This is not only illegal but is against the Realtor's Code of Ethics. This agent could be fined or have her license either suspended or revoked.
